By accessing or using Campdesk ("Service"), provided by Campdesk, Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Description of Service
Campdesk is a cloud-based campground management platform that provides reservation management, payment processing, guest communication, and related services for campground operators. The Service includes web-based software, mobile applications, and associated features.
Account Terms
Account Creation
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old or have parental consent
- One account per campground operation unless otherwise agreed
Account Responsibility
- You are responsible for all activities under your account
- Notify us immediately of any unauthorized account access
- Keep your contact and billing information up to date
- Comply with all applicable laws and regulations
Payment Terms
Pricing and Fees
- Fees are charged as a percentage of your online bookings
- Current pricing is available on our pricing page
- Payment processing fees are included in our service fee
- No setup fees, monthly minimums, or cancellation fees
Payment Processing
- Guest payments are processed through Stripe and deposited to your linked bank account
- Our service fee is automatically deducted from each transaction
- You receive detailed transaction reports and tax documentation
- Refunds and chargebacks are handled according to our refund policy
Acceptable Use
Permitted Use
You may use Campdesk solely for operating your legitimate campground business and managing guest reservations.
Prohibited Activities
- Using the Service for any unlawful purpose or illegal activity
- Violating any local, state, or federal laws or regulations
- Transmitting spam, malware, or other harmful content
- Attempting to gain unauthorized access to other accounts or systems
- Reverse engineering, copying, or creating derivative works
- Reselling or redistributing the Service without permission
- Using the Service to compete with Campdesk
Data and Privacy
- You retain ownership of all guest data and campground information you input
- You grant us permission to use your data to provide the Service
- We will protect your data according to our Privacy Policy
- You are responsible for complying with applicable data protection laws
- Upon termination, you may export your data within 30 days
Service Availability
- We strive for 99.9% uptime but cannot guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- We are not responsible for downtime caused by third-party services
- Service credits may be available for extended outages per our SLA
Intellectual Property
- Campdesk and its features are protected by intellectual property laws
- You receive a limited, non-exclusive license to use the Service
- You may not copy, modify, or distribute our software
- All trademarks and service marks remain our property
- You retain rights to your campground data and content
Limitation of Liability
Important Legal Notice
TO THE FULLEST EXTENT PERMITTED BY LAW, CAMPDESK SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Lost profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Third-party actions or content
- Damages exceeding the fees paid to us in the prior 12 months
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
Indemnification
You agree to indemnify and hold harmless Campdesk from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
Termination
By You
You may terminate your account at any time by contacting support. No cancellation fees apply.
By Us
We may suspend or terminate accounts for:
- Violation of these Terms or our policies
- Non-payment of fees
- Fraudulent or illegal activity
- Prolonged inactivity (after notice)
Dispute Resolution
- These Terms are governed by the laws of Colorado
- Disputes will be resolved through binding arbitration
- Arbitration will be conducted by the American Arbitration Association
- Venue for arbitration is Boulder County, Colorado
- Class actions are waived; disputes must be resolved individually
Changes to Terms
We may update these Terms periodically. Significant changes will be communicated via email or through the Service. Continued use after changes become effective constitutes acceptance of the updated Terms.
